The availability of alternative sentences is based on your specific situation. Judges consider a wide range of factors when deciding whether you are a good candidate. For example, California judges will consider:

• Your risks (flight risk, danger to society)
• The nature and circumstances of the crime you’ve been convicted of (violent crimes like murder, robbery or rape make you ineligible in most cases)
• Whether imprisonment is necessary to protect the public
• Your previous criminal history
• Whether your crime involved a weapon
• Whether you are currently on probation or have failed to complete probation in the past

Types of Alternative Sentences in CaliforniaIf a judge grants you an alternative sentence, you will generally be given a choice of several options for how to serve that sentence. At times, however, the judge will choose the sentence for you, or a state statute may mandate a particular sentence.Depending on the crime for which you were convicted, California law allows a wide range of possible alternative sentences:

• Voluntary house arrest or involuntary home detention
• Electronic monitoring (ankle bracelet)
• Monetary fines
• Community service
• Work release/Community Work Program
• AA meetings or Narcotics Anonymous meetings in DUI or drug offense cases
• Drug/alcohol rehab programs
• Probation, including drug diversion probation

Individuals who are interested in completing the PC1000 course must satisfy several requirements:

• Be a first-time drug offender
• Voluntarily accept admission into the program
• Plead guilty to the appropriate charge

The drug court program includes a regimen of:

• graduated sanctions and rewards,
• individual and group therapy,
• urinalysis testing commensurate with treatment needs,
• close court monitoring and supervision of progress,
• educational or vocational counseling as appropriate, and

other requirements as agreed to by the presiding judge or his or her designee, the district attorney, and the public defender.Additionally, the defendant will be required to cover all expenses related to the course, including admission fees. Mental health diversion

California now offers general mental health diversion under California Penal Code 1001.36. PC 1001.36 lets some people with mental disorders get treatment when they are charged with a crime.As with other forms of California “pretrial diversion” successful treatment leads to the criminal charges being dismissed. The record of the arrest then gets sealed for most purposes and it is generally as if the arrest had never happened.To qualify, the defendant must suffer from a condition listed in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders. Most conditions qualify, including:

• Bipolar disorder,
• Schizophrenia,
• Schizoaffective disorder, and
• Post-traumatic stress disorder (“PTSD”).

Upon the successful completion of that phase of the program, 

The defendant pleads guilty to the charge(s) and sentencing is postponed for one year. If he/she is charged with a new drug case, the judge immediately terminates participation and imposes a sentence. However, if the defendant successfully completes the program, his/her charges will ultimately be dismissed.This program is tailored to an individual’s needs and may include any or all of the following:

• obtaining a high school diploma,
• enrolling in a city college,
• securing full-time employment,
• stabilizing housing, or
• attending counseling and/or therapy.
